If a criminal and traitor like Flynn can get away with it because an appeals court was told by Trump's capo Barr to drop the case, then outright treason is now acceptable if it benefits Trump personally. President Biden will have his work cut out for him cutting the Trump taint from our nation's judiciary.
I don't know. I think a hearing had already been scheduled, but the smart thing for Sullivan to do would be to sign the dismissal order.
I guess that's the reason the IG recommended charges be brought against Andrew McCabe, the guy who made this sham possible.
The FBI, under Comey, has some real problems here. especially since it has been revealed that Flynn was never unmasked. In case you can't figure it out, that means the FBI obtained the transcript illegally.
And it goes much deeper than that. Evidence has now been revealed that Biden, Obama, and Comey conspired to take out Flynn:

Here is the Court of Appeal's full legal reasoning for why the case had to be dismissed.
In this case, the district court’s actions [Wilkin's attempt to maintain the charges] will result in specific harms to the exercise of theExecutive Branch’s exclusive prosecutorial power. The contemplated proceedings would likely require the Executive to reveal the internal deliberative process behind its exercise of prosecutorial discretion, interfering with the Article II charging authority. Newman, 382 F.2d at 481 (citing United States v. Cox, 342 F.2d 167, 171 (5th Cir. 1965)). Thus, the district court’s appointment of the amicus and demonstrated intent to scrutinize the reasoning and motives of the Department of Justice constitute irreparable harms that cannot be remedied on appeal. See Cobell, 334 F.3d at 1140 (“[I]nterference with the internal deliberations of a Department of the Government of the United States ... cannot be remedied by an appeal from the final judgment.”); see also Cheney, 542 U.S. at 382.
Since yesterday's bombshell news that the decision to go after Flynn was made in the oval office by Obama himself on the very day Trump took office. Susan Rice's e-mail to herself in and attempt to cover for what took place rings hollow at this point. Her e-mail to herself about the meeting that took place in the oval office two weeks prior said, "Obama said do everything by the book." doesn't hold up.
The notes specifically state that Obama ordered Comey to "put the right people on the investigation". In this case, itmeans the it would be handled by a small group of people on the 7th floor of the FBI headquarters. Flynn's prosecution was a deliberate attempt to undermine the Trump administration by the outgoing administration. This makes Watergate look like a Sunday school picnic:

Evidence that has come to light shows that these two media narratives are factually false. The FBI literally fabricated the lie part and the media was in on the gambit because they were informed by Comey's friend about the phone exchange. It was Comey himself who informed the professor who leaked to the news media. The question they put to Pence was a setup.
At this point, no one in the Administration believes that Flynn lied to the VP. That was a narrative that Schiff, the media, and the top floor of the FBI pursued to get Flynn fired.
They should have dropped the matter there, but didn't. They decided to go after Flynn which eventually led to the revelations we are seeing now: Obama, a sitting President, on the last day in office directed the FBI to pursue a course of action against a member of a new Administration for the purpose of undermining the new administration. It doesn't get much worse than that.

Having a conservation with a foreign ambassador does not make one a foreign agent; nothing that Flynn said to Sergey Kislyak was even remotely criminal. FBI was pretty sure they had evidence he has had contact with people he said he didn't have contact with at the time and then he plead to lying about it. He also moved goal posts when initially confronted:
After The Washington Post published their story, Flynn's spokesman released a statement on February 9 tempering Flynn's denial, describing that Flynn "had no recollection of discussing sanctions", but also "couldn't be certain that the topic never came up".
