    Default World Court upholds German immunity in Nazi cases - A shameful day to be a European

    THE HAGUE, Netherlands (AP) — The U.N.'s highest court confirmed Friday that Germany has legal immunity from being sued in foreign courts by victims of World War II Nazi atrocities.

    The International Court of Justice said that Italy's Supreme Court violated Germany's sovereignty in 2008 by judging that an Italian civilian, Luigi Ferrini, was entitled to reparations for his deportation to Germany in 1944 to work as a slave laborer in the armaments industry.

    The ruling is expected to stem the flow of civil cases launched against Germany in Italian courts in the aftermath of the Ferrini verdict.

    Germany had argued that the Italian ruling threw into doubt a restitution system put in place after the Nazis' defeat that has seen Germany pay tens of billions of dollars in reparations since the 1950s.

    The 15-judge world court said in a 12-3 ruling that the Italian case violated Germany's long-standing immunity, which has been recognized in international law, from being sued in national courts.

    "The action of Italian courts in denying Germany immunity ... constitutes a breach of the obligation owed by the Italian state to Germany," world court President Hisashi Owada said.

    Rulings by the International Court of Justice are final and binding on states.

    German representatives argued last year that if the world court sided with Italy it would open floodgates for restitution claims by individuals around the world, a situation it tried to avoid in negotiating reparation accords with Israel and with countries that had been occupied during the war, and with specific groups such as the Conference on Jewish Material Claims against Germany.

    German Foreign Minister Guido Westerwelle welcomed Friday's ruling, saying it confirmed Germany's view on state immunity.

    "The clarification was not only in the interest of Germany but also in the interest of the international community. It is good and it serves all to have legal certainty now," he said.

    Westerwelle stressed that Germany's decision to go to court was not aimed at diminishing the country's responsibility for Nazi war crimes.

    "The (German) federal government has always recognized their pain," he said. "And, of course, the aim is also not to question German responsibility for the crimes of the Second World War."

    The international court rejected Italy's argument that states' immunity did not apply in cases of war crimes and crimes against humanity committed by one country's army on the territory of another country.

    Italy's chief representative in the case, Paolo Pucci di Benisichi, said the result helped clarify the limits of states' legal immunity.

    "We are not disappointed," he said. "Of course, I would have preferred a judgment that was closer to our line of defense."

    He said Rome likely would not have launched the case at all had it not been for the fact that Italians interned by Germany during the war were not included in existing reparation schemes.

    The court's judgment noted with "surprise and regret" that Germany had excluded such victims from compensation.

    Although Italy was a German ally during the War, many Italians were deported by Nazi forces, interned in camps and used as slave laborers.

    Rome's case was supported by Greece, whose citizens have similar claims against Germany.

    In 2008, the Italian court decided on the seizure of Villa Vigoni, a German-Italian cultural center on Lake Como, to "enforce" the claims by Italians and Greeks seeking compensation. Germany's protest against the seizure formed part of its appeal to the World Court against Italy.

    Italy never formally enforced the seizure, pending the result of the world court case, and it will now likely be reversed, Pucci di Benisichi said.

    The Greek case involved residents of the Greek village of Distomo, where Nazi troops killed 214 civilians on June 10, 1944 — one of the worst atrocities in occupied Greece.

    Worldwide justice grieves in this shameful display and selective treatment of some of the worst crimes committed in the history of modern Europe. The victims are to receive no compensation for the disgusting war crimes committed by the Nazi German troops in Italy and Greece. The truth is that Germany has been awarded an immunity for the death of millions of innocent people in the expense of rebuilding W. Germany and creating a strong buffer state for the defense of Europe against the USSR, during the Cold War.     Nazi Germanys surviving leaders were put on trial, some executed, the state already has payed considerable amounts of cash in Reperations and more.
    I dont see how germany "Got away with it" compared to the countries you mentioned.

    I dont see how germany "Got away with it" compared to the countries you mentioned.
    Tens of thousands of the German criminals guilty of the Holocaust and other nazi crimes (for example, murders of thousands hostages in the occupied part of the USSR), avoided punishment. It is a lot of high-ranking criminal nazi officials, officers, managers occupied high situation after WWII - instead of getting to prison or on the gallows

    Why should Germany still be paying reparations? Have they not already payed their WWII debt? Why should they still have to be paying money for this?

    Still? Already? What are you talking about? What does time have to do with what is being discussed? Time does not heal the victims' wounds. Many people who suffered back in the 40s are still alive and have not even received compensation for the crimes inflicted. Germany did not pay compensation, at least not to the extend it was supposed to.

    I'll ask it again. Did Germany not already pay its reparations?

    I am sorry for the victim. I do not see why they shuold have to pay her though. Germany has paid her debt.

    Nope. If you had read the thread, you would have known that a village which suffered more than 200 slaughtered people pursued the case.

    Because the Greeks demanded money from them, and now can't anymore.

    Because your debts are actual debts created by a failed economy and mentality that lasts til this day, and you've been completely unwilling to even accept that you're in the wrong, let alone do anything apart from cost us more money and whining about it, when we've appeased you time and time again, and eventually it's going to run out.

    The Germans lost a lot in the war, and were punished severely, and ever since the end they've been sincere in their efforts to apologize and change, even too much, one might argue.

    I agree.
    Germany has paid its legal duty and cant be made legally to pay anymore.
    Even Israel who suffered the most are happy with the cash they rightely got.

    Coz our stupid leaders were weak and signed a legal agreement saying we will do so and we will receive punishment if we do not.Also if we want more money we have to do as they want.
    Maybe the best thing is for Germany to cut off some of the loan they gave Greece as a sign of goodwill and that cash can go to victims but i would imagine the corrupt Greek government would waste it on new cars for themselves etc

    Absolutely . The fact that Britain, France and USA got their hands on the German economy and loot of war does not mean that Yugoslavia or Greece did.
    Britain and USA and France were the ones along with the Russians that had to defeat them in battle.
    Are you mad your leaders did not get their pound of flesh well blame the government you had they were probably as bad as the recent ones LOL

    And how is that relevant? Not only Britain, USA, France and USSR participated in the war but a whole lot of countries of which, many were invaded, destroyed economically and suffered hundreds of thousands or millions of deaths.

    There's no such thing as the will of the Greek people when PASOK continues to govern, when taking 8% of votes according to polls. As for Greece, it won't be able to enter the markets for the next 20 years anyway. And I was under the idea that Argentina was in constant austerity for 10 years because it was following the orders of IMF? Then they made their political leaders leave with a helicopter in order to survive and Argentina started healing itself from the gangrene of IMF.
