Enron's big boys have a problem. Judge to tell jury "deliberate ignorance" not a defense.
This severely weakens the old favorite deniability/stupidity/incompetence defense. It has long been my belief that corporate leaders should be held fully accountable, rather than allowing them to escape by saying, "I didn't know that is what was being done."If the jury agrees with the prosecution's argument that fraud occurred at Enron under Lay and Skilling, he said, they would not need to decide whether the two had direct knowledge of it, only that the two executives should have been aware of it.
