I guess the 0/1 6gb sata ports dont suffer from the issue. So if you have the new motherboards make sure you dont use the 3gb ports.

I didn't see anything in the Tom's article that wasn't implied or explained in the Anand article.
Honestly, Tom's is one of the lesser quality tech sites while Anand is one of the better ones. It's the trade off for being bigger I guess. That's not to say Tom's is complete crap, it's okay depending on the article, but 99.98% of the time, I'd go with Anandtech over Tom's Hardware.
Problems are with the chipset (ie motherboard) and not the CPU. Actually, if you only use the SATA III ports, you're okay.
it makes no sense not to return it. Just wait for more information, the OEMs are going to release soon. There is no sense in having a POSSIBLY defective product.
