It doesn't work without the patch. I can load the autosave that is in the file and it works. But when i start a new game so that i can choose with what side i want to play the game kicks me everytime back to the menu.

yeah, I guess I don't have the patch, sorry. This quote from the OP implies the crash on startup can be fixed.
"As soon as you will select the faction to play with, you will probably encounter a crash to the main menu, due a problem present in the descr_strat file: in the region of Rome there's the temple of Iupiter Latiaris, not present in the building database. I'm pretty sure I haven't fixed that prior I packed this version. You have to erase that building and the campaign will start ...If I remember correctly that building has been only half-implemented by me and thus a CTD."
I'm not sure what else was included in the patch but I do remember playing this a while ago. I not sure if I had the patch at one time or if I just fixed the error in the descr_strat.

I removed the temple of Iupiter Lataris and it works. Thank you.
