Your problem is: "NVIDIA GeForce 9500 GS", and this "Windows Vista".
I assume its a laptop, sooo im not sure what to suggest here.
Update your directx, and graphic card drivers for starters.

You need to to disable the UAC. http://windows.microsoft.com/en-US/w...trol-on-or-off
Then try installing directx 9.0c. http://www.microsoft.com/downloads/e...displaylang=en

I did it with Vista 1.0 release.

If you still have problem, come on back.
Your 9500GS is not good for your resolution or ulrtra settings.

Thanks but i might just try what dushveti1 said.I dont like to because that last time i modified something with my computer i had to reinstall every thing including my windows vista I had lost every thing and my computer was vista from the beggening and the thing was I changed the memory because one of my games needed less than I had and would not work for some reason and I followed a guys instructions on how to and... ya... So im not in a hurry to try something like it again.

It's your choice. Empire is XP/C++ 2005/directx9.0c and without them you are not playing long if at all.

I have been doing this for almost 23years starting with DOS 3.1. I'd like to have a quarter for everytime I have had to reformat a harddrive and reinstall the operating system because of a bad program inluding games.

Yes reinstalling you OS is not the worst thing to happen. Just backup your data and there shouldn't be any problems. Also as irshron suggested, the best OS for your system would be windows xp, and not vista. Hell i would't suggest installing vista to my worst enemy. The thing is sluggish to death -.-
