    Hi there.
It can be captured. Are you sure it was not sinking after having surrendered? Or when the battle ended? Since a sinking ship is for ever lost. Sad but true. I have done it once a long time ago, but lately I have also lost the USS constitution to the British, just to see her sail away as part of the Royal Navy.

Well I can't be sure it didn't sink, but thank you I guess I'll have to be more careful nest time. BTW USS Consutition I had was sunk and lost also I guess .

Some big arse ships surrender but not enough and slip out. Same thing happens with Napoleon TW. Guess you have to board them to really capture them.

Using chain and grape shot is much better on ships you want to capture, they lose a lot of morale when dismasted or low on crew so that you don't have to damage the hull too much.

I captured Victory as the spanish and they still say VICTORY reporting in spanish. But yes, big ships always keep running until you sink them or board them even if their sails are gone

The thought of losing the Constitution or the Victory to the AI isn't too pleasing to me. Kinda wish there was an option to order your crew to scuttle a ship instead of them surrendering. If I was losing a fight with one of those, I'd rather sink the ship myself instead of letting the enemy capture them.

There's a difference between decommissioning a ship in port and scuttling it in battle. If I was losing the fight, I'd order my crew to scuttle the ship in battle and sink it themselves.

They'd better listen to me if I ordered them to scuttle the ship. Other wise I'd have the lot of them drawn and quartered, while on fire.

You would have to draw and quarter them personally, and make sure they didn't tip you over the side, then eulogize your heroic death in action.

Note that in the event you engage in a naval battle against multiple fleets, IE which ever one your attacking, or is attacking you and nearby enemy reinforcements I have found that even if you disable every ship in the reinforcement fleet, it tends to let you only pick from those in the main force you engaged afterward.

Kinda frustrating... at least this has been my experience.

    Victory?
If you do not have the SF Edition, you can not recruit HMS Victory.
USS Constitution is a pre-order (now SF Unit), is a US unit available in RTI 4 (and 3).
