The name ''Total War'' is intellectual property of CA, so if anything the modders of that mod could still be sued.
Logically, they cannot own the phrase "total war" save for in the case of referring to their game franchise. The use of mods is expressely allowed. The phrase "total war" could probably be saved in the event of a mod use through plausible deniability and a very good lawyer.
But putting together "Napoleon Total War" just seems like a blatant copy.
Though at the same time, it could as well pass off as a coincidence or plausible deniability

But seriously, yes, the modders could sue. I could go sue a monkey for having more hair on his head than I do (goddamned monkeys!). They would not win, and it would cost them a ton of money, but they could do it.

Ummm we have 12 nuclear powered super carriers. the US has the most advanced and largest airforce and navy in the world. The brits do have amazing special forces though, and i do admit that. but the navy seals are quite good, and come close to the SAS.
im sorry but europe has gotten a bit pacifistic. They don't have strong wills to fight any wars. The only exceptions i can think of are the brits, and maybe the poles.
Not to mention that the member nations of the European union have no united foreign policy. It's a very loose confederation, pretty much only united economically, which as we have seen in the last few months, has been somewhat of a burden.

Did we also mention that we have Canada and Mexico and Afghanistan and Iraq and Poland on our side? And while China may not be very friendly to us, I'm sure we've been far kinder to them than Britain has.

Well my original idea seems to have been slightly misinterpreted, and now that it's been brought out into the open, sounds ridiculous even to me. The concept to me seemed to be that a team of modmakers make a mod based on the Napoleonic era of warfare and call it "Napoleonic Total War". Almost a decade later, the original company that made the games releases an expansion pack named "Napoleon Total War"
No, they cannot sue CA.
