Default Sexting, Crime, & Sexual Hysteria

I'm sure we all have heard stories in the news about sexting cases. They come in different varieties; juvenile to juvenile, juvenile to adult, solicited, & unsolicited.

My question is, if the person sending is a juvenile, is it right to charge them with a sex crime? In the US, that means a criminal record and Megan's Law, where you a put on a public watch list as a sex offender.
To be governed is to be watched, inspected, directed, numbered, regulated, enrolled, indoctrinated, controlled, checked, estimated, valued, censured, and commanded, by creatures who have neither the right, wisdom, nor virtue to do so. To be governed is to be at every operation, at every transaction noted, registered, taxed, measured, numbered, assessed, licensed, admonished, reformed, corrected, and punished. It is, under pretext of public utility, and in the name of the general interest, to be placed under contribution, drilled, fleeced, exploited, monopolized, extorted, and robbed; then, at the slightest resistance, to be repressed, fined, vilified, harassed, abused, disarmed, choked, imprisoned, judged, condemned, shot, deported, sacrificed, sold, and betrayed; and to crown all, mocked, ridiculed, derided, outraged, and dishonored. -Pierre-Joseph Proudhon

Because I'm not totally familiar with the categories used to determine what goes where. I have a vague notion, but I figure, if it's in the wrong place, a mod will fix it. Thanks for the feedback.

So one minor sent another minor a nude photo of themselves. If they did it of their own free will, then that is there choice. I don't think they should be charged with a crime, as they'll have to live with the consequences of having their photo travelling around the ether... This is simply the 21st equivalent of flashing your bits to the quarterback under the bleachers after school... except that it lasts a lot longer.

As for the boy who got arrested after having his phone seized. If he was stupid enough to keep it on his phone, and then use the phone in a way likely to get it confiscated by teachers... well, he's an idiot certainly. But a sex offender? I doubt it.

If any adults were involved, then certainly they should be charged.
Young lady, I am an expert on humans. Now pick a mouth, open it and say "brglgrglgrrr"!

What's most alarming about this is being entered into the sex offender registry and all that entails. These kids, and they are just kids, have exhibited what may (or may not) be construed as reprehensible behavior, but a sex charge seems completely ludicrous.

This isn't an isolated incident. Lives are being destroyed. A girl in NC I believe committed suicide because she was put up on charges of this kind. I'm not trying to argue from an example here, I'm trying to ascertain what fundamental principle is being violated.

I could press the matter still further, but I have no wish to offend the sensibilities of some people. However, I find it disgraceful that flashing a little TnA (which teens do anyway with regularity) gets you a sentence and on the Registry. It's the Law run amok.

Especially considering that the law that they are being persecuted with is a law that was intended to protect them.
"Every idea is an incitement. It offers itself for belief and if believed it is acted on unless some other belief outweighs it or some failure of energy stifles the movement at its birth. The only difference between the expression of an opinion and an incitement in the narrower sense is the speaker's enthusiasm for the result. Eloquence may set fire to reason." -Oliver Wendell Holmes Jr.

"Daddy I want a cell phone".

    "No".

"But what if there's an emergency?"

"You're ed. Stay out of trouble. In fact, not only are you not getting a cell, I'm going to take something you already own away from you for trying to manipulate me".

But no, that's too hard it's more like:

"We'll give you kids everything you want except boundaries and positive role models because we love you so ing much!"

Anyways I won't loose any sleep over these little who think it's fun to publicly humiliate someone like that. I was never a particularly sensitive kid but this is some really heartless, sadistic stuff. The parents must be so proud for raising such apathetic little humanoids.

Of course it isn't. It's a ridiculous and counter-productive view on natural relations.

In my school there was a rather funny cause of this, not sexual images or any kind of pornography. It was very funny, but it could have turned out badly. Someone used a joke SMS site to send a message from a teacher's number to a pupil, asking if he wanted to have some "bedtime". There were lots of problems with this, but I couldn't help laughing my ass off when hearing it

teenagers ahve always experimented with sex and sexual activities, its a natural part of growing up. Sexting is simply a modern approach to an age old phenomena. If its consensual between kids, I don't think the law should be involved.

That said, the modern world creates modern problems. A photo destined only for the boyfriend can find its way round the entire school, either deliberately or inadvertantly. The impact of this on the subject can be devastating.

    @ op

if you live in a country that treats children like adults (in crime cases)
then you shouldn't wonder about that.
