They warn you countless times in SOI not to do anything to EPW's after you capture them, and for this very reason. All they have to do is claim you hit them and you're career is potentially ruined. And then you lie about it? And throw everything away because you punched someone who was in custody anyways. Navy SEALS especially should know better.

Well, this case in particular highlights the utter stupidity of the current environment that we are having forced down our throats. And that largely has a home in human rights groups who have gone off the deep end long ago, and the oh-so PC, and liberal over-intoxicated continent of Europe.
This guy could just as easily have gotten it in the teeth, during his capture. And I bet that is exactly what happened. In that sense, if he put up a fight, there is nothing preventing this SEAL from fighting back.
All this guy has to do is scream loud enough for this to become a story, and claim whatever he would like. SEAL makes a false staement knowing the fine line he walks in today's military, and the rest is history.
