So, in order to punish the mastermind of the most recent attack on the US, Obama will let the terrorist get the likely mistrial.

Because even if for some insane reason they don't get off because of the waterboarding and torture (or even for not getting their Miranda rights read to them), I have the feeling that the fact that it is taking place in NEW YORK CITY might make the jury a little bit biased, which off course the defence could use.

KSM is not going to get off. There are multiple charges against him. He has admitted openly to beheading Daniel Pearl. If he does get off over astronomical odds, he just goes back in shackles, to any of the other countries that have terrorism charges on him, and are less inclined to appease the people who have an issue with military tribunals. In that case, there is no doubt that he dies.

A military trial is legal, its been accepted by the Supreme Court as well when challenged back during FDR's days.

Actually a person has a higher chance of being acquitted in a military trial then in a civil trial. Also, Its going to be very chaotic in a civil trial. Your gonna have loads of mistrial because the jury is always going to get some anti-american on it who votes "not guilty" despite the loads of evidence against mohammad.

It could easily be done if a Justice Department guy turned the Judge presiding and say, give this man a trial, and find him guilty.

I'm not sure which country you live in, but for the severity of the charges, a Judge can't find him guilty. Just so you know.

No, but Judges absolutely do influence the course of trials. A Judge that is harsh on certain types of crimes is far more likely to show favoritism to the prosecution and thus, the jury is given a more one-sided perspective.
