    Well of course not, that's why I'm asking if it should be. My opinion is this, you are married to that man/woman by law, therefore if you break that marriage, you break the law.

    Once again, it's not legally anything (kinda sad that the world has degraded to think marriage merely a title). This entire thread is to debate of weather it should be.

    Think about it, you just proclaimed that the man or woman you married is the love of your life, that you will be with them during the good, the bad, the ugly, the sick, and the well times. Yet you go off and have fun with someone else. You don't see anything wrong with that? You don't see any harm being done to others, a "contract" more or less being broken?

    No, I mean can you think of any legal reason it SHOULD be illegal? What is happening there that the government should punish you for? You can argue that there is moral cause to make it illegal, but that doesn't hold up very well. Everything that is immoral is not necessarily illegal. You have to have some reason ulterior to moral ones. Whats more, marriage is not necessarily a christian institution in the world of law. What if swingers are married? Are they just doomed to be illegal having different commitment ideologies?

    Illegal? Perhaps not... But I personally find it lamentable that such a thing is so casual today. Not only that, but various conceptions of punishing adultery are thoroughly criticized and rejected with little thought given at all to the severity of the offense itself.

    I'm not going to be startled or offended to see the arguments presented saying "humans are social animals," or "it's nature," etc., etc. They are as sure to come as the sun is to rise.

    Adultery is morally wrong but making it illegal is a perversion of freedom; it grants the government way too much authority over someones life and personal decisions.

    Adultery should not be illegal.

    If you can't keep your spouse faithful you either picked wrong or need to work on your technique.

    Not to mention that how they would most likely define said law would mean that if your wife brought over her hot friend for a 3some it would be illegal

    No adultery should not be illegal. Marriage is a social contract between two people...it can be religious and unfortunately the government has seen fit to interfere in it for various reasons but no where in the modern marriage contract(the governmental legal one, not the religious one)does it say anything about who one is allowed to have sex with. It is nothing more than an agreement to cohabitate and share certain responsibilities in exchange for certain legal and monetary benefits granted by the government.

    What do YOU know of marriage? You are not married, you are years from it, have you even had your first kiss yet, and you want to talk about how adults live their lives? How arrogant do you think you are to suggest you understand marriage in the least?

    A MAJORITY of married people cheat on their spouse at least once. Thats right, 60% of men and 45% of women cheat, period. There are reasons for this that are not based on religion but on biology, we are a species that has evolved for pair bonding (marriage) with affairs. It makes genetic sense but I won't get into it in this thread. We are very similar to most 'monogomus' birds. Monogamy in the western tradition was only established in the last 1000 years or so. Before then cheating was expected and the Church considered prostitution to be a necessary part of life. Its only been in the last 100 years that its been taken seriously for males.

    Now do you want to hear some stats that will blow your mind?

    Swingers tend to be college educated, married 10+ years, income above the average, lower than average divorce rate and republican. If I recall the number 1 profession involved was teaching.

    But don't let your lack of experience stop you from deciding how people twice your age should live their lives

    Ok but I do have to ask. How would a swinger be cheating if his wife/her husband was with them?

    Adultery should not be illegal in the since of commit adultery, go to jail. You are correct that it violates the marriage contract and therefore is grounds for divorce, usually with a financial penalty being payed to the wronged individual. That's how it should be. Marriage is a civil contract and violation its terms is grounds for a civil case, not a criminal one.

    Adultery shouldn't be illegal because how can you force people to stay to gether, maybe they should have been divorced but whatever and if adultery is ok with some couple why make it illegal, social consequences are enough surely.

    You can't force people to remain married. At least, you can not force people to cohabitate as a married couple. Some states require a Separation Period before final divorce is awarded. But, the option is there to apply for a Divorce and be rapidly declared as Separated. There is no reason why either party could not avail themselves of that right.

    I would tend to agree that if this is some sort of sexual practice and is consensual between all parties, then it would not, necessarily, be the State's position to intrude. The State tries fairly hard to stay out of most people's bedrooms.. normally.

    The "Social Consequences" for that behavior may not be as stringent as one may think. Certainly, it's frowned upon by many and decried by most. But, not everyone would know, would they? There are also still plenty of "Swingers" and "Wife-Swappers" out there.

    Not reasons for it to be illegal though, if one member of the marriage feels that adultery is a true betrayal than there will be social consequences with probable divorce otherwise it downgrades from there, some may be angry but forgive their partner on the understanding it wont happen again and then as you mentioned there are swinngers and wife-swappers. So for those that feel truly betrayed than there is already suitable punishment, though now that I think about there would be the case of the lovers running of together and ignoring their families thus negating the impact of the social pressures.

    Still adultery being illegal does not sit well with me not that I would do it myself ofcourse.
