IIRC you open up factions_tables in the DBeditor and in the "type" column you put "playable"
in what file do i have to mod? the main pack or patch pack?
create a new pack file that is mod type with Pack File Manager:

With the first editions of ETW, it was pretty easy to increase the number of playable factions in custom battles, but with the new patch (1.5), I wondered the same as Major Payne. Your info helped to get me back on track, RO Citizen, so I thank you for that, but you left out several rather big blanks I had to figure out myself. So, if there is anyone else out there who, for different reasons (for example, checking different unit retexturing mods to see which units to choose for the campaign), wants to try out different factions in custom battles, I post my finished solution here (which is probably one of many out there). This person or persons can do the following:
1. Download the attached file
2. Extract the downloaded file to your desktop (for example)
3. Put the extracted "32_factions_in_custom_battles.pack" file in, if on a XP computer, the C:\Program Files\Steam\steamapps\common\empire total war\data folder (or wherever you have ETW installed)
4. Then enable the little mod by either:
a) Open the "user.empire_script" text file in the C:\Documents and Settings\[Your Account On the Computer]\Application Data\The Creative Assembly\Empire\scripts folder (visible only if the setting for showing hidden folders and files on your computer is enabled), and write...
mod "32_factions_in_custom_battles.pack";
...on a line there, save, and exit the text file, and then start up ETW anew; or...
b) Use the Mod Manager which RO Citizen provided a link for above to tick the box for enabling the mod in that program.
Now, in custom battles, you can play almost any of the factions that you can enter diplomatic negotiations with in the beginning of the campaign, with the notable exceptions of the Colonies.
