Tort reform is the first step to any meaningful healthcare reform and always has been. The problem is that the Trial Lawyers Association is well-funded and well-organized. It's worth noting that the term "trial lawyer" has such a negative connotation that they changed their name to the American Association for Justice a few years back.
They are not interested in great justice, but great big settlements.

Absolutely. Plaintiffs are not the one's who win in these cases, just the lawyers. One of the big reasons healthcare continues to become more expensive is because of the outrageous malpractice insurance that doctors have to pay for.
A lot of people try to say that tort reform would be putting a "price on human life", but asking for any money in a malpractice case is already putting a price on human life.
Tort reform in healthcare is one of the key systemic reforms that could really help us all out. Anyone who would side with a lawyer over a doctor can join them on their trip down under. (and I don't mean Australia, although I've heard its pretty hot there too.)

Makes no sense to me if one is going to tackle reform that one doesnt tackle the biggest hurdles, first. Things like the public insurance option, dont get me wrong Ill support it depending on how its implemented but wouldnt that be far down the list behind tort and behind drug companies? Those two are the biggest elephants in the room, one causes doctors/hospitals to take out insurance for protection which of course the costs roll down to the patient and the other amounts to arguably the single biggest outlay of money on a single aspect of health care. Just makes no sense, I actually give a nod to Howard for atleast being honest in saying they wont tackle it but his reasoning is imo flawed, you HAVE to tackle it Dean otherwise you arent fixing anything just putting a bandaid on a wound that needs stitches.
Obama already told the AMA to diddle itself over tort reform, only not in so many words.

I don't have the references to this anymore, its from right when obama was elected in Illinois and it was really a Durbin thing but Illinois has a problem.
Doctors are leaving in droves due to the malpractice costs, especially OB/GYN's. Well Durbin, came up with a plan for this problem. Tort reform? No, you see the problem was the insurance companies being greedy (WTF?) and the fix would be to have the state, aka the TAX PAYERS, pay for part of the malpractice costs in Illinois.

If that was his solution to the problem then Durbin is a <insert curse word> idiot of course people like Edwards defense is but then large companies will take advantage of people harmed by their medical procedures or such. Well doh that is the point of reform, to make it better to make it so people actually harmed can sue without the absurd lawsuit happy country we have become.

Hell, recently a drug company offered Obama an insane amount of money to run ads supporting his healthcare reform bill in exchange for a promise that Medicare won't be able to alter drug prices. But it's not suspicious, I mean it's Obama....OBAMA...
