    Israel declares the shooting of American activist, Tristan Anderson to be an “act of war”

    18 August 2009: Israel declares the shooting of American activist, Tristan Anderson to be an “act of war.”

    Tristan Anderson, an American national, was critically injured on 13 March 2009 when he was shot with a high velocity tear-gas projectile during an unarmed demonstration against the Wall in the West Bank village of Ni’lin (report and video: ).

    The Israeli Ministry of Defense has notified the Anderson family’s lawyers that Israel perceives the incident on 13 March 2009 as an “act of war.” This classification was made despite the fact that Anderson’s shooting occurred during a civilian demonstration and there were no armed hostilities during the event or surrounding it.

    The consequence of such classification is that according to Israeli law, the state of Israel is not liable for any damage its’ forces have caused.

    Israeli police have completed their criminal investigation and passed the file to the district attorney of the Central District of the Israeli prosecution offices. The Anderson’s criminal attorney, Michael Sfard, is awaiting their decision.

    According to Michael Sfard,

    If a process by which unarmed civilian demonstration is classified by Israel as an ‘act of war,’ then clearly Israel admits that it is at war with civilians. International law identifies the incident as a clear case of human rights abuse. As such, Tristan and his family are undoubtedly entitled to justice and compensation. We will pursue this matter and take the government of Israel to court.

    In addition to filing a criminal complaint against the State of Israel for the shooting of their son, the Andersons have submitted a notice of intent to file a civil suit.

    Leah Tsemel, the civil suit attorney, stated,

    This is another occasion where the Israeli government is alluding responsibility. The demonstrations that take place in Ni’lin and Bil’in are not acts of war. We will pursue, in Israeli courts and international courts if necessary, justice for the Anderson family.

    Tristan Anderson was critically injured on 13 March 2009 when he was shot with a high-velocity tear gas projectile by Israeli forces. He was taken to Tel Hashomer hospital near Tel Aviv and to date remains in the hospital facilities. Tristan suffered multiple condensed fractures as a result of being hit in the right frontal lobe. He has had several life-saving surgeries and his prospects for recovery are unclear. On 10 August 2009, Tristan underwent another surgery to reattach the top part of his skull, which was removed in order to save his life immediately after his shooting five months ago.

    Several eye-witnesses have given testimony that Tristan was shot when he could not have been perceived as any threat to the forces in the area. He was shot from around 60 meters while standing with a few internationals and Palestinians, hours after the demonstration had dispersed from the construction site of the Wall.

    “We are horrified and overwhelmed,” said Nancy Anderson during a press conference on 23 March 2009. “We are scared and really still in shock. To shoot peaceful demonstrators is really horrifying to us.     Israeli forces have been systematically shooting tear-gas projectiles directly at demonstrators during protests at the West Bank Wall.

    After Anderson’s shooting, the Israeli human rights organization B’Tselem requested the Judge Advocate General, Brig. Gen. Avichai Mandelblit, to immediately clarify to security forces that it is absolutely forbidden to directly aim tear-gas canisters, including extended-range type canisters, at demonstrators in the West Bank. B’Tselem also provided extensive video footage of demonstrations in Ni’lin, Bi’lin, and Jayyus showing repeated firing of tear-gas grenades directly at demonstrators, proving that, contrary to the army’s contentions, Israeli forces in the West Bank have commonly practiced this unlawful act.     Following the killing of a Palestinian demonstrator in Bil’in, Basem Abu Rahme, by Israeli forces on 17 April 2009 with a high velocity tear gas projectile (report and video: http://palsolidarity.org/2009/04/6185), B’Tselem again demanded that the army enforce its Open-Fire Regulations and investigate the incidents (http://www.btselem.org/English/Firea..._on_People.asp).

    I think War on peace is a much better description for western and israeli actions in the middle east over the last 8 years than war on terror...

    You would think this would provoke anger in America... but im sure they have thier top pr people on the job as we speak...

    This is only to be expected from Israel. Anyone remember this story?

    British Journalist Killed By Israeli Troops

    Actually I saw the documentary that James Miller was helping to make when he died. He was the cameraman for a documentary on the plight of Palestinians caught up in the middle of what the Israelis call a 'war zone'. He and a female reporter who was presenting the documentary were inside a Palestinian house when an Israeli APC (manned, according to the Palestinians in the house, by Bedouin mercenaries employed by the Israeli army) arrived outside. There was gunfire, and eventually the journalists decided that it wasn't safe to stay in the house. So they mocked up a white flag and left the house - with the cameraman still filming. You could hear a gunshot, then the reporter says, "We are British journalists." Then, after thirteen seconds you can hear another gunshot - the gunshot that hit the British cameraman in the neck and killed him. The Israelis' official excuse for this was that the journalists had walked out into the middle of a gunfight and were caught in the crossfire, something that the film that the cameraman was shooting clearly disproves.

    So, shooting civilians who are walking under a white flag? I think that counts as a war on peace too.

    Three weeks after James Millar was shot while walking under a white flag, Tom Hurndall (a peace activist) was shot by an Israeli soldier as he attempted to move save children from Israeli gunfire. The Israelis tried their soldier for manslaughter; however, the St Pancras Coronor's Court in Britain (in a rare move of gutsiness for a British institution) declared that Hurndall had been unlawfully and intentionally murdered.

    Yes, "war on peace" sounds like a good description.

    Im not saying that this is wrong, but its represented from a totally wrong poitn of view.
    First i dont know where the war on peace was pulled from.
    second, the "act of war" was legaleese, It means that a soldier without orders to do so fired on a civilian directly (possibly with or without the intention to do it) with a tear gas canister. It can be a lethal weapon if thrown hard enough of course, but so can a rock to be fair.
    Since tear gas is considered fair use for crowd-disbursement, the only question is if its true the border guard actually intended to throw the canister to injure or not, one way or another I dont think that it makes sense for the Israeli government to pay recompense because of a border guard making a mistake, especially towards a non-Israeli national who chose to be in an occupied area (Even by international law, an unarmed civilian going into such a zone willingly for non-huminatarian authorized purposes would be on very thin ice, and I dont believe one bit in international law)
    Anyway people should take it with a grain of salt, Hebrew legal language is not always what it sounds like when translated into english.
    Anyway id like to say again this story is meant to lead you to the wrong conclusion, it tried to get you to think that a small metal canister thrown by hand is on par with a bullet. He basically "/fienghs shock" had a few bones in his head slightly fractured. There have been worse brawls in bars .
    And even then, it hasnt even been classified as an "act of war" yet, if you actually read the article, the ruling has not happened yet.

    Why would it? Its not like the US doesnt have its fair share of cops who beat people over the head with a baton, or even shoot them point blank with a bullet and get away with it scot-free . I know its not the same situation but anyone making more of this then it is is an idiot.

    And james millar was walking at nighttime outside a building to soldiers who most likely did not speak english. Its funny how people misrepresent these things and are then surprised they figure out they have no background of what theyre talking about at all.Their family decided to make a of money instead of asking for extradition for the soldier too.

    You realize that protesters getting tear gas rounds during demonstrations isn't exactly rare right? The only reason this is news worthy is because an Israeli official decided to make a rather stupid comment on something that is quite simply not worth commenting on.

    Unless you mean "the inhabitants of palestine" in which case you have to include the jews as palestinians.

    No, the Palestinians have lived there since the dawn of time. The Jews just moved there from Europe last century. They should consider just going back to their native lands of Poland or whereever they came from.

    There were jews in Palestine before the buzzword palestinian as reffering to arabs who lived in Israel existed (Which happens to be around 1950-ish, give a few years, 1967 is when it became popular. )
    Or there were palestinians which includes jews who lived in palestine and never left despite the roman occupation (not many, but there were certainly some)
    As a side note, i see people dont care much about the guy who got bumped on the head anymore.

    You know very well that's not true. The Israelis of today are not related at all to the Jews of Pre-Christian Palestine. The current Palestinians are the true natives of the land, who were Christianized, Arabized and Islamicized, but natives nonetheless. Native Jews of Israel most probably went extinct during Roman times after the diaspora.

    All current Israeli Jews are just Europeans who moved to Palestine in the last 100-150 years and have no genuine links to the land. Aside from fictional Zionist claims. But then again Israel's very existence is a fictional one and it's the key reason Israel has no right to exist and will cease to exist hopefully within out lifetimes*.

    I cant find any motivation why jews would want to remain jews through 2000 years of christian opression other then the fact that they would be devoted to their religion, and most historical sources claim otherwise then your theory that jews were wiped out. but go ahead, try and persuade me that your theory is right and that all the original jews died. And the Khazars thing is nonsense, if no jews were alive it would be very unlikely for them to learn anything about judaism, and it would be literally impossible for them to convert.
    And thats even ignoring that jews have religous texts dating from after the romans expelled the jews from palestine and that they are consistent. You know. Like the talmud?

    Incorrect. The British called everyone who lived in Palestine... Palestinian. Palestinian is a nationality, not linked with race or ethnicities, but national identity. Once Jews called themselves Palestinians. They merely adopted a new nation once Israel was founded. It's like the Americans after the revolution.
