    Default Portuguese frigate thwarts pirate attack

    REUTERS - Portuguese warship Corte-Real captured, disarmed and briefly detained 19 pirates armed with high-explosives after they attempted to attack a Norwegian-owned oil tanker in the Gulf of Aden, NATO officials said on Saturday.

    Crude oil tanker MV Kition radioed for help on Friday afternoon after a skiff full of pirates brandishing assault rifles and rocket-propelled grenades approached them, said NATO Lieutenant Commander Alexandre Fernandes from on board the NATO warship.

    "They were about 20 nautical miles south of us and we were the nearest warship, so we immediately scrambled our helicopter," he said.

    Helicopter pilots Marco Coimbra and Pedro Gomes-Bras spotted the skiff and began tracking the pirates who fled the circling helicopter to the safety of their mothership.

    The Portuguese escort frigate began hunting the mothership, a dhow with 19 heavily armed pirates aboard. After a high-speed chase the dhow was intercepted and by evening, eight marines managed to board the vessel.

    The special forces discovered four 200g sticks of the chemical high-explosive P4A, four AK-47s and one rocket propelled grenade launcher with nine grenades, Fernandes said.

    "It was almost a kilogramme of high explosives," he said. "If used correctly it can open a hole in the hull of a ship and sink her."

    "It is the first time we have spotted high explosives on board a pirate ship, normally they just stick to AK-47s and RPGs," Fernandes said, adding that he did not think the explosives signalled an escalation in violence.

    "They thought they needed it, but an RPG is a more offensive weapon," he said.

    There were no injuries reported and Fernandes said the pirates did not shoot at the Bahamas-flagged merchant vessel, the helicopter or the marines.

    "They surrendered immediately," he said.

    After consulting with Portuguese authorities, the Corte-Real, which was last week recalled from other duties to fight piracy in the Gulf, released the pirates, Fernandes said.

    Each warship on NATO's anti-piracy mission Operation Allied Protector must comply with its national regulations on dealing with captured pirates.

    Note the last two paragrapher.
    Here in Portugal,the Penal Code is to permissive,barley the robers gets arrested,even the murderers,if presented by them selves to a one police authority,just go home with "term of identity and residence" (I don't knew the Anglo-Saxony expression to go home in almost peace),so I am not surprised for this released.

    i think they let them go because of the reported lack of shooting and somewhat immediate surrender.

    there's cases of rapers being released



    there was a robbery at a bank, where one of the robbers was shot by the police sniper and the police got lots of critics, becouse they were brazilians, and that was being racist blabla







    another case was of a car hijacker that was caught, and sent to the court

    after he got out (yes he was released), right in front of the tribunal he stoled another car to went home

    he was caught again, and again.. released (but didn't stoled a new car this time)

    I think it has to do with international law... Dutch navy recently stopped an attack as well and had to release them too. Simply because they dont' have any jurisdiction in international waters and couldn't charge them for anything either... Laws need to be changed before they can keep them in custody otherwise they will just be released by a judge.

    Well, for clarification, they are following NATO ROE. The NATO anti-piracy operation states that unless hostages are taken, they must release the perps. However, countries like the US have argued against this, and have done differently in the past, much to the chagrin of our NATO allies. But what else is new?

    It all has to do with lawyers. And European lawyers at that. They are the people who tell NATO what the ROE will ultimately look like.

    Now, as of yesterday actually, NATO is reviewing its ROE, again. The main point of contention with commanders is the releasing of perpetrators of piracy. So hopefully sometime within the next few months, the ROE will be ratified. The main point of contention continues to be that EU countries don't want to personally detain these people within their justice system. So they are trying to get countries in the region to accept them. Good luck...

    Releasing them isn't anything new, the US had to do that when the Golden Nori was taken. US gunships even escorted the hijackers' boats back to land. They were in Somali waters (as much as they can be in the waters of a failed state) so they can't do anything with captured pirtes anyway, aside from dropping them off in neighbouring countries for 'justice'.

    The US also really had no precedent to hold them given it was a Japanese ship, flying a Panamanian flag. Neither country wanted to detain the pirates.

    It is somewhat ironic that they had to release the pirates due to international laws, considering the very first international laws ever created stated that anyone who captures a pirate can judge and sanction him.
    For every action there is an equal and opposite government program.
