Everyone except Rome can capture Eagles. It's based on a hardcoded trigger (CapturedLegionaryEagle), so I'm not sure what the exact condition is.
You can get descr_strat.txt from the zip file. You may also be able to get a fresh copy from the non-BI campaign map folder.
so its not the "eagle" from triarii?
I'm sure that I've won them before by completely destroying a large Roman force. There have to be too few survivors for the army to reconstitute, I think.

I never lost an legionary eagle and I begin to wonder why?
I see mostly triarii carrying the eagle on battlefield, but even if I get utterly defeated with all my triarii dead or routing, I never lose an eagle... So do I need to meet any other conditions for that? A dead general perhaps? :hmmm: umm no that would be nonsense...
Once lost, I guess it is only possible to regain the eagle if I defeat the character that has taken it from me, is that right?

In RTR, I lost an eagle when the Macedonians captured Antigonia from me. It doesn't have anything to do with where it is (I captured eagles all over the Balkans as the Western Empire against the Eastern Empire in Invasio Barbarorum). The only factors are how big the enemy's army is (it has to be big enough to constitute a legion) and how many of them you kill (I think the enemy has to be completely destroyed, meaning that the survivors run away and hide. I have also captured an eagle against an army not led by a family member. The way to recapture it is you have to take the settlement it is taken to (it says that on the message that appears).
This may sound dumb: but what's the benefit -for a non-Roman faction -of capturing an eagle?
If your army is led by a family member, then he will gain the trait "Eagletaker", wich grants him +1 Influence. 2 eagles = +2 Influence, 3 eagles = +3 Influence ( and the guy can call himself the "Eaglecollector")
Also, I think the enemy might try to take the eagle back, but I cannot confirm this.
Hm... playing Carthage, i somehow managed to capture the "Eagle of Messana" for the third! time.
And btw: the "egaletaker" trait also grants morale bonus to all troops on battlefield.
I captured an Eagle once against the Senate playing as Julii. Sadly I had no General in the unit, so does that mean it goes to the Captain of the unit then? (Trait)
And another thing, Eagles are only the First Legionary Cohort and Early Legionary Cohort right? Those are the only 2 units you can capture Eagles from?
And how exactly do you do this? I captured eagle because Rome had 2 armies against 1 of my armies. Sadly the 2nd army only consisted of a First Legionary Cohort and the rest where garrisoned in Rome. During the battle I killed of all the Legionnaires in the First Cohort except the Captain who managed to escape all because they were close to my men. And after the Captain retreated, the 2nd army retreated as well. So to capture an Eagle what do you have to do?
You just have to utterly crush the Romans in a battle.
