    Default Copyright issue

    When in menu (and perhaps in game as well), there plays theme from The Last of The Mohicans. Isn't this illegal to use mr. Edelman's composition in mod? Of course, others have copied from him too. Check out Nightwish's Stargazers for example, but isn't the music in the mod straight from the soundtrack?

    Not that I complain - I like it, but I believe that this is somekind of Copyright violation. Or is it?

    correct me if im wrong, but i think that it only violates the copyright if you redistribute it to make profits, and since this is not a mod that you buy, it is not in violation.

    Big Brother/King Kong is watching.

    I think that is wrong because if you make a copy of a DVD you don't own its a copyright law violation. Although I could careless about that!!

    You are wrong muffin (hehe, no offense). You can be in violation for distribution without the intent of making profit. The main impetus is that there are lost profits to the copyright holder since those who now have the copyright piece did not pay for it. I hope that makes sense.

    Now Promentory (the song in question) may not be subject for a numerous number of reasons, or the copyright holder might not care.

    Agree, and I doubt mr. Edelman knows that SS exists that uses his composition.

    Here is my take:

    As an artist, I woud be flattered if some (free/community)mod decided to use my music/artwork/whatever. If they asked me, I might even make something just for them.
    Here is why:
    1. Hey, they must like it since they decided to use it.
    2. Free pr!! Someone might even buy something from me later. (I actualy bought kingdom of heaven, after playing SS :p)
    3. I'm not a greedy bastard.
    4. It helps the modding comunity

    It's just to bad that some artist and most record-company/managers/whater don't see it that way.

    Ofcause, if the mod later stopped being non-profit, then they woud recive an invoice.

    A note on number 4:
    DayOfDefeat, some time after being bought up by valve, switched to a very strict policy on copyright, on the msa part of the forum. Nedless to say, a good portion of modders stopped modding the game, something that in turn drove away some players.

    It is illigal to use other people's work, unless king kong has permission OFC. But downloading it is not unless you live in copyrightsthan.

    It's most likely illegal, but not necessarily illegal. There are several reasons it could not be illegal. For example, the song could be considered Public Domain (It is not), or the copyright holder could waive his rights (probably hasn't).

    Downloading a song without permission from the owner is also illegal, as is distributing it. However, distribution is considered far worse.

    I don't believe this is true. I believe a law passed in 2005 which made it illegal to download copyright works off the internet as well. I'll see if I can find a reference (only things I've found are in norwegian, and I can't read norwegian).

    Well, I didn't post this because I was conserned about Randy Edelman's or the record company's feelings. Clearly putting someone else's song in mod without permission isn't legal. Not that I disapprove that, but the copywright owners might do so.

    The 2005 paragraphs to the copyright law changed 3 things.

    It became illegal to share illegally downloaded software (even for non profit).

    It became illegal to crack and bypass copy protection unless it is commonly available. (IE if you find it on the net it is ok if you do it yourself it is not). This is how infamous DVD Jon got of the hook. He had the software he made posted on the net, it was commonly available and not illegal.

    It did also became illegal to download pirated software but this is a law no one can be charged with because it. 1 is too common. 2. is commonly available. 3. It is not illegal to share a bought DVD/ CD/ game with a friend thus this not illegal to download. It is a law that is there but doesn’t mean anything like the blasphemy paragraph.

    (yes Norway has an anti blasphemy paragraph)

    So, I conclude from our legal experts opinion presented in the previous posts that everyone who downloaded SS6.0 and played the game is breaking the law. However, if you mute the volume when the Last of the Mohicans is playing, I think you are "not guilty".

    since I own the LotM soundtrack, I'm pretty sure I'm in the clear, but the rest of you are screwed.
