    Default What constitutes rape?

Is it a mere lack of consent, or something more?

Rape is sex by force, date rape is a woman who changes her mind

Expressed lack of consent. Plain and simple.

To put it this way, a rape where the victim does not put up physical resistance is just as psychologically scarring to the victim as one where he or she does put up physical resistance. There are also those who pester their boyfriends or girlfriends to have sex with them until they eventually give in, and even that feels terrible for them.

I've got many friends who've gotten raped. It's not something to which I'd subject my worst enemy.

Rape is sex by force, date rape is a woman who changes her mind
Rape is sex without consent, date rape is sex without consent during or right after a date.

Lack of consent, or full knowledge of what is going on.

rape is defined by the law; it is not defined by the individual, nor your individual concepts of rape.

so underage consensual sex between say a 19 year old and an 11 year old is totally illegal and should be punished like any true violent rape.

again the LAW defines what is rape.

Can we keep the law out of this? The laws of the United States of Amerikka are grossly unjust, and if we're just defining this by what the books say, then this topic is said and done with.

    What about morally?

Also, Chaigdel, your slavish devotion to the law makes me worry for America, as statists such as yourself enable tyranny.

So if I have sex with a 11-year old girl (I'm 22) against her will in a country where doing so is not illegal, I have not committed rape?

Sex without consent, by force or drugs.

It is possible within the law, I think the United States and many EU countries where a woman can enjoy having sex with a man and even say that she consents to it. Then a few months later regret having sex with him then call the police and put that man in jail for rape.

countries that are considered to have "high" rape conviction rates are only at around 50%

the uk has something stupidly low like 6-16% conviction.

as irishman said its a very hard things to prove and the courts need a bit more then just "he raped me" and while it has happened very few women would even consider doing that as they know how much trouble a guy can get into.

rape is when someone is forced to have sex against there will at the time of sex. (regretting it in the morning doesnt make it rape)

Kiki, no thats not possible. Rape is very hard to prove, and it is never taken solely on the word of the victim.

If there is consent, then there is no rape. She could lie and set him up, saying she didn't consent, but this is simply framing.
