so in the sea Battle this turn i am only able to get Clear defeat and heroic victory, and one of my spies are having a hard time opening a gate With 40%

I was away and did not set up a co-admin for this hotseat - I'll fix that.

Issue #1 - Naval victory results

The rule - No heroic victories unless it is impossible to achieve a different result (at least 5 reloads)

Since the battle can also result in Clear Defeats, a Heroic Victory result can not be allowed. Unfortunately, naval autoresolve AI is notorious for strange outcomes.

Issue #2 - Spies opening gates

The rules regarding spies are not relevant here because it is a question of why spies cannot open the gates with a 40% chance. If the game does not allow the player to open the gates, then as admin I won't intervene. Each turn the game calculates a number 0-100 that it applies to chance actions like gate opening or spying. The admin or player has no control over it and it would be unfair to the defender to change the outcome. A 40% chance isn't likely, anyways.

That's not how that rule works. It only means that you can't open gates for settlements with over 900 men garrisoned.

Unlike the case of infiltration, where you can infiltrate a settlement no matter the odds, given you have some patience to reload a couple of times, opening gates do not work in the same way, as JWANT stated above. You can have 50% odds of opening the gates, which doesn't mean that with a couple of reloads, you can finally manage to open them, if you couldn't do so earlier. The game sets a percent level and you have to reach it in order to open the gates. So it's not about reloading anymore, if that's what you think.
