You can only kill him if you join the Empire, and at the Battle of Windhelm I believe....

I have a piece of advice, do not tush into a side on the civil war. A lot of people join the Stormcloaks as they think it is fun to be a rebel and the Empire are evil for the Talos worship ban, but as you get further you find out more about both sides ie the Empire had to ban Talos worship and Ulfric is the biggest, most racist douche in all of Nirn.
