You should go to the Praetorium. The Tribunal looks whether the ToS has been applied correctly - and it was.

You can question that in the Tribunal. The mods think he broke the TOS but he says he didn't do anything wrong and the mods are wrong. I don't see how this cannot go in the tribunal, there are worse cases in the tribunal.

The question here is how you will prove that the account in question is actually used by your brother.

Not a lot you can do really, compare posts maybe to see wether there are substantial differences in posting style but I think the "brother" hasn't got a lot of posts and most of them are in the who am I thread where you won't find a lot of diversity in posts.
