[Amendment] Expanding the role of Magistrates

PROPOSED AMENDMENT:

Article III. Judges

To serve on the Tribunal, a panel of two Tribunes is appointed by the Hexagon Council. Tribunes can only be drawn from the ranks of those with at least a Silver Moderator's Mace or from those who have served as Magistrate for at least one term.

In addition, three two Magistrates shall be elected, one every two months for 3 month terms, by the procedure in Section II, Article II. Applicants cannot have received a warning an infraction in at least one year and must have been citizens for at least 3 months. Magistrates cannot serve consecutive terms.

Magistrates rotate as acting Tribunes, each deciding voting on one of every threetwo cases. Should a Tribune recuse himself or there is a tie between Tribunes, the Tribunes chooses one of the two other the other Magistrate respectively votes in their stead or is called to break the tie. Magistrates are terminated by a unanimous vote of the Tribunes. A terminated Magistrate is barred from standing in the Magistrate election immediately following their termination.

Mind you, I did not have any specific "third Judge" in mind when writing this proposal.

That is a very good literal reading of the posts involved. However, I was trying to be sneaky and insinuate that it seems fishy, planting a seed of doubt into the collective mind of the people. Well, not really, I was actually just trying to teasingly goad Garb into clarifying. That was the object of my post afterall, which was why I addressed the post to him.

I was aware of Hotspur's future appointment and of Hex's decision to replace him, appointing me as a judge about a month prior to my proposal.

Do you seriously think I would do something that could be patently demonstrated as self serving and lose my credibility towards the Curia, and for what? In fact it would be much easier to push the amendment through after I had been appointed, stating "my recent experience from the Tribunal", no?

The Amendment was subsequent to a lengthy discussion in Hex, and the sole reason was that both me, Ian and GED are very fond of the Tribunal and we want it as empowered as possible.

No, thank you Garb. I consider myself a decent judge of character (as do most people I imagine) and didn't seriously expect you to do that. I hope you can see how it could look fishy though. Disclosure would have averted this, but I understand why you couldn't say anything until the positions had been announced. Now that you've said this, it doesn't look aquatic at all

One question that I forgot to raise when this was being discussed both the first and second times around, so forgive me for overlooking it, is what happens to the currently serving magistrates? Do they all get to serve out their terms and then this kicks in? Or will their terms be shortened by three months?

No Amendment can be retroactive except if a special clause has been inserted, and in that case, it has not.

Also I support this amendment. Though unlike Harry I did find the gulf war veterans trapeze act both tasteful and entertaining.
