Most provinces are protectorates of the old empire and are not directly controlled by it, so probably a bit of both.

You'd have to destroy the Imperial remanent, then either bring the provences back into the Alliance or, if they fail to come back into the Empire, crush them and force them to join you.

I will opt for the latter because the AI doesn't seem to understand what alliances mean. I wish there could be a script where your AI allies send you a stack when you call upon their support in a war.

Question: will skyrim's basic troops be based on the hold guards from tes V?

I think the factions should just start out as the present polical situation at the beginning of Skyrim. With the Stormcloaks (Could be referred to as Skyrim in the faction name) controlling Eastmarch, the Rift, Winterhold, and the Pale. Argonia has completely annexed Morrowind with the exception of Vvardenfell which was destroyed in a volcanic eruption. The Aldmeri Dominion controls Somerset Isles, Valenwood, and Elswer. Hammerfell is independent. Of course, this makes less factions, but I'm just voicing my opinion.

From my point of view there are many ways to do that.
1. Just via diplomatic relations. (Like in teutonic Kingdoms campaign, where Teutonic order has "Very Good" relations with HRE, and abysmal with Novgorod
2. Via alliances and vassals. For instance every faction could be a vassal of the Empire, although I believe that wouldn't work.(It works perfectly at Akthross TW, but everything is scripted there. So such a system could work if game started near the Aldmeri Dominion invasion, since we know much about the following events).
3. The Empire could control settlements in the other "countries" ie Solitude in Skyrim and Ebonheart in Morrowind.

All provinces, except for Black Marsh, Elsweyr and Summerset Isle are vassals of the Empire, and the Imperial Legion will have forts all across their empire.

With Kingdoms and Lusted's AI they tend to keep Alliances until they run out of places to expand.
