The Tribunal can judge whether or not what TDLS did crosses the line of the rule as generally understood. Whether or not Arcturus exists without mens wear should be irrelevant. The rule is there. The evidence is there. Does the evidence fit the rule?

Of course, if TDLS wants to argue intentions and whatnot, he can try the Praetorium, which allows any arguments the appellant desires, rather than the strict comparison of evidence against the rules which the Tribunal works on.

He didn't know that his post was deleted by moderation. He wasn't trying to defy moderators, he was trying to debate.
There's no evidence that shows that he intentionally reposted after deletion by moderation, only that he reposted. A PM from the Moderator or a statement by the moderator in the thread warning about post deletions would have changed the trajectory of this, no?

As it stands, there is sufficient doubt as to TLDR's defiance of moderation to grant him his appeal, imho.

I see Sharpe's Company following his party line of playing the victim of the establishment. His shaky relationship with facts notwithstanding, there is also the apparent contempt for jews he displays such as his 'Jo jewess Coburn' remarks when describing a BBC presenter. In this context it is abundantly clear he meant to insult Denny with his 'joke' image. Typical posts from him brimming over with bile and accusations at those that disagree with him.

I fail to see how this was a banning offence, I admit though I do see an overzealous mod in Jom.

He constantly tries to ban people he doesn't agree with, he is full of hate.
So, the one who posted this got an infraction for insulting people? Surprise, surprise.

This alone makes a very bad case for him in the tribunal; apart from the obvious insult, that is.

Edit: Just realised that you can interpret my first sentence to be something it isn´t. I just mean that I would expect some insults of a member who posts that in his tribunal case.

As much as one can interpret into the history of a member or an image of a caricature,
it somehow technically isn't an insult imho.

    The picture will return the viewer whatever he wants to see in it;

    a jew

    a jew with a beard

    a man with a beard

    ...and a cappy

    ...etc.

off course it can return the viewer also all the other stuff that might be taken
into consideration when thinking about it as an insult but technically it doesn't
say nothing but whatever you want.

On the TDLS case, if the Tribunal had not already noticed from the screenshot Squid posted. The first and last TDLS posts were 6 hours apart. Do you really suppose the member had something on his mind, noticed that the post hadn't gone through, and presumed it was a technical problem, 6 hours after he'd posted his first instance?

You're saying that me reposting mutliple times due to presumption of technical problems is not plausible because there is a large time gap between posts?

People have lives, a scenario could easily be created that would have TDLS press "enter" and not take the time to notice whether or not he actually posted. Perhaps he was rushed for classes or something, which would then explain the 6 hour gap, and when he came home noticed the post wasn't there and assumed in his rush something didn't go right.

Just saying, I've had it happen to me before.
You cannot pick and choose what to follow from your holy books. If you are truly a Christian, you must follow the bible by the letter. One read through Leviticus, where the disabled are barred from Church attendance, and homosexuals should be the least of your worry. It's the whole book or none of it, and to follow the whole book is to be immoral.
    So it goes.

    He posted it 3 times.

    1st post: 3:24am.
    2nd post: 3:45am.
    3rd post: 9:33am.

TDLS gave a BS defence, and the Tribunal swallowed it whole. Good on him. The lesson the mods need to learn from this is to have a concrete and specific warning of some sort, so this kind of pretence gets short shrift. It's a lesson I learned early on.

Care to explain how the time difference between posts make my defense not plausible or are you gonna keep on throwing accusation while ignoring me?

    Appeal 801 is finished.

The Tribunal didn't swallow any BS, we find it most unpalatable. The whole affair was thoroughly investigated and significantly debated in Quarters. If anyone wants to continue the issues raised by this appeal they should do so in a more appropriate place and in a specific thread. This thread is for current appeals only so if you please......

Sorry Harry and not to be that who speaks out in the wrong place but I have to agree with pann here. Not saying you swallowed but that defense reeks of it.

Unfortunate to see that TWC's hidden jewish lobby has silenced Sharpe's Company again.

Denny must be really good - single handedly ruining an entire economy. Oh wait, who got infracted for insulting others?

New standards continue to be set.

Kudos to Soren for his moderation in Sharpes Co thread.

It seems to me that, we have had a gradual increase of derogatory statements on Twc, the whole appeal was a major...Insult to have to review at all, to make matters worse there wasnt even an argument by the defendant, at all during the discussion, just insults directed at a different member
