    ...Is pretty straight forward. All it takes, is to ask in the moderator forum, and you got your answer. Sure, it might not be precedent and can seem missleading, but then you should ask if you are in serious doubt.

    You also got moral obligation to start a thread on it, so others don't fall in the same pit.

    Appeal 548 - [Non-case]
    Jankern. Removed but this case got no grounds.

    1. If he has served his time for past notes, ban, etc. then it should not be relevant... atleast witht the numbers of post allready down.

    2. Søren is right, from his pov and I like that junior mods stand for it. The Moderator Handbook is what is wrong and can be missguided, in this context.

    No, it's not that simple. If it was in the Thema diva, then that could be the case. Since the poster posted in VV - then no.

    2. Saying "He's home schooled" alone, is not insulting. Therefor the context of this case is vital for infracting Magic Man. What msg was it directed to? The OP? Well if that was the OP, then we need it, because it's now deleted.

    Hesus would be the best translator I believe, him not being part of the discussion and being a mod. But the translation he gave is quite correct, but doesn't make it any less insulting.

    i have to say master/dr rush, its doesnt matter what you felt you meant even though its glaringly obvious, if the guy took offence to such a blantant remark then thats that. case would be pre-decided

    It was directed at me, the context is obvious. I was debating, and since he knows all about me since he follows me around, he told people that since I was homeschooled, my knowledge was bad when it comes to science. I reply to him on his profile with a link of college success rates for homeschooling compared to public schooling, to show him he is false. He then replies in a message directed at me which will remain hidden except to the moderators in charge unless they want to reveal it that continually insulted them.

    The context is key here.

    Implying is the same. Also note this isn't the first instance hes done things to me. The last two times hes been suspended have been against my brother and me.

    He was obviously implying that I wasn't smart due to my schooling. How else could it have been taken?

    No: Implyig he did say it, is not the same as saying he actually did say it. There is a irrelevant point of view inbetween.

    Is there a 'law' in the ToS, which state or imply: several Mod Interactions towards a specific individual, gives additional or easier future convictions?

    PS: Getting personally involved is never a good idea. Involving your kin, is bordering personal referance.

    Master's defence is ridiculous! My sources inform me that calling someone an ape is as bad in Dutch as it is in English. His defence is like "yeah, I called him a bastard, but I actually meant that he's a great guy!"

    We both agree contex is everything, but still the remaning key of context remains hidden: The PM, which is not open to the public. Therefor the case has not brought sufficient evidence supporting "hes homeschooled" is worthy of an 'insulting others'-infractions.
    Again, in the end - I think we both agree. I also guess you personally are done persecuting? "...in the name of not harassing"

    There are no credible evidence linking the statements.
    So you can throw out insults vaguely, but if you don't quote the person, then there's no way to prove it was against them, and therefore is not against the ToS? That seems pretty pitiful. He was aiming it at somebody, and who else could it have been? The key to the present is the past.

    Which he stated he already provided to the moderation staff. Your complaint seems to revolve around the fact that you can't see the PM in question. Since you have no part in deciding the issue, and the PM has been provided to those who do, what's the problem?

    Edit: Magic Man states in his Tribunal thread that the PM has nothing to do with the case. If true, then it will solely revolve around context of the post in the thread in question. At the very least, as a personal reference in the D&D, it's off topic.
