To me this is also bizarre. But a lawyer confirmed to us that technically if you are creating something LOTR on your own (even in private) you are infringing. That means if you are painting an Arwen picture on your own, you are infringing (Of course WB wouldn't persue you for it, because 1. they don't know about it and 2. it wouldn't help their cause (and PR) to go around and hassle people, really. But they would be legally right to to make you stop painting Arwen pictures).... That's at least the case for the U.S. and many E.U. countries. Recently I've been to China and they couldn't care less about this there. Hell, they even have the pilosophy that "you are raising someone's fame and renown if you are copying him" and that it's the highest praise and tribute to someone if you are trying to copy him. :tongue:

You mean with time passing by normally? Then we are talking about ingame years that you'd have to spend before something happens in your ingame life. I was talking about casual gamers the other day and how they have influenced the game industry for the worse, but that would be the other extreme :tongue:

Im gonna assume that WB is more upset by it because they want to make a LOTR RPG or something. Dont think that a LOTR Total War is on their to do list, especially when it seems to me that PC gaming is dying
Oh well, better get this mod before it gets too late :P
And just to say......when it comes down to it in the end......torrents. Might not have fancy nice website, which would ruin everything, but you know, the torch would be carried on into the darkness of the intrawebz

actually most EULA's just say you can't alter the function of the engine thats why we can mod med 2 but we have to do it inside hard coded limits .. what your talking about ,extending copyright law through these contracts, only happens in the US it seems afaik
and the EULA's were born to stop you taking the license holder to court if there software damages your system. to the best of my knowledge

We had a comment on our moddb site that says it all: "WB is communicating slower than Ents."
But until now, they always were communicating and responding, so we think they will sooner or later now as well. The difference is that the current (very important) answer is taking unusually long. We hope that this means something good (but it can mean something bad, of course)

Yeah, modding games is legal and allowable as long as you dont hax it
Especially allowable if the game company gives out modding tools. Skyrim has modding tools, right?

it does its the LOTR copyright that is the issue , bethesda actually encourage modding .. they have a mod manager for there games

could it happen? yes
will it happen? probably not worst case scenario the WB's cease and desist letter stands, then they realize the mod was published (the modders would have to prove the thieving scenario) and then they would come after the modders for infringing copyright and financial damages resulting in hefty fines or jail time

I have Skyrim on xbox - so I haven't had the pleasure of seeing or playing MERP....
But this still sickens me to the core. I feel for the modders that have put their time and effort into this project; not only because they've been forced to stop working on something incomplete, but because they now fear they could be in trouble for what they've already created.

oh sorry my post was hypothetical :tongue: based on a scenario where the MERP mod was released despite the cease and desist letter
while the modders are technically in trouble as long as they do not ignore the cease and desist letter (as long as it stands , hopefully not much longer) and release there mod WB can take no further action
still feels like a kick to the nethers though...

Until they decide otherwise. With Steam they'll have the tool to enforce their forbidding, reminding the Steam users they have just bought a licence to use the game like Bethesda want.

Plz forgive my ignorance if this was mention before couldn't they get in touch with the tk estate to do the mod m the books wb already got in trouble for infringing with the hobbit movie. The estate might be more willing to allow it

WB has a copyright to produce games based on the books
once they acquired this they have the right to enforce it until it expires , don't think the TK estate has any power there
and i don't believe WB got in trouble for the hobbit i believe they got in trouble for producing casino and video games using Tolkien's characters i may be wrong on that last point though

The problem is that under copyright law if you fail to enforce your rights to the copyrighted material you lose your rights. WB is under an obligation to enforce(or at least look like it is trying to), unfortunately.

you are confusing trademark and copyright .. what you said is true of a trademark but copyright law has a set period in which they have a valid claim . If they don't take action immediately this does not exclude action at a later date if they feel like it
